论我国解禁流质契约的必要性

随着社会经济的发展，自罗马法传承至今的禁止流质契约的态度开始松动。对我国而言，解禁流质契约更具有必要性：允许流质契约不但更好地体现私法自治、契约自由原则，而且兼顾公平与效率、完善我国现行的担保制度，更是对已遭破坏的借贷信用制度的恢复。
