摘    要:城乡分割的二元土地制度导致了小产权房现象的产生。小产权房是非特权阶层对特权阶层既得利益的挑战,是对现行法律法规实践效果的否定。它表明社会公众在理性运用最终承认规则宣判了目前土地制度的不合理。相关法律法规应作出调整以适应社会的发展。

Abstract:The dual urban-rural division of the land system brings about the phenomenon of non-property- right house. It is the challenge of the benefits between the non -privileged class and the privileged class. It is the negative effects of the practice on laws and regulations. It indicates that the public in the spontaneous use of "the ultimate recognition of the rules" rationally sentence the current land system is unreasonable. Relevant laws and regulations should be made to adjust to the social development.
