试论土地储备风险及防范

本文认为,市场经济体制使土地储备行为合法化,也带来了土地储备的风险。面对各种风险,当地政府应通过立法表达政策的严肃性,严格遵守一座城市应只设立一个由政府直接领导的土地储备机构(或地产集团)的政策,减少对土地储备机构的营运干预,依法收储。土地管理部门应在理顺法律关系的前提下,完善土地收购储备运作机制,以土地储备制度保障《城市建设规划管理法》的顺利实施。土地储备机构应采取合法的资金运作方式,建立资金的良性循环系统以防范风险,对土地储备贷款可能出现的风险加以切实的分析和防范。文章提出,通过国家完善土地储备的相关法律制度,健全土地执法监察体制,是当地政府、土地管理部门和土地储备机构等三个行为主体应对风险防范的根本保障。

Risks of Land Reserving and the Risk Preventing System

The author points out that, with the development of market economic sy stem, land reserving is legalized. But the legalized land reserving also brought about some risks. Facing with these risks, the local government should, first, act in accordance with the law; second, improve the operation mechanism for land reserving; third, adopt lawful measures of capital operation. The author puts f orward that improving the oversight system by improving relative law system is t he guarantee for the participants to prevent risks.
