试论我国社会保障制度的改革与发展

自建国以来,在推进社会保障体制改革方面,我国制定了相当多的规范性文件,已经初步建立起社会保障制度.但是这些文件对改革的推动作用还存在很多方面的不足,主要是规范性差、刚性欠缺、权威性不高、稳定性不足等,必须通过立法来明晰主体各方的社会保障责任,规范社会保障关系,要从依靠政策转为依靠法律,充分发挥法律在建设社会主义法治国家中的作用,从而能够提高制度的权威性、执行的严肃性、适用的强制性.

A Tentative Study on the Reform and Development of China''''s Social Security System

Since the founding of the new China a great number of documents have been formulated to regulate and promote the development of the social a security, and a preliminary social security network has been established. However these documents still leave much to be desired in terms of regularity, enforceability, authority and consistency. Therefore it is necessary to draft relevant laws to define clearly the responsibility of relevant departments and agencies and to standardize the relationship in social security work. There should be a shift from dependence on policies to dependence on laws in building up a socialist legal frameworks so as to enhance the authority of the legal system intensify the strictness and compulsiveness in the enforcement of the laws.
