即发侵权若干问题的探讨

自加入世贸组织后,我国法律面临着与相应制度全面接轨的问题。即发侵权是应TRIPS协议规定增设的一项制度,它对我国"无损害即无责任"的传统侵权制度提出了极大挑战。应在探讨其构成要件与立法功能的基础上完善这一制度,使其符合TRPIS协议的要求。
