| 摘 要： | 近年来,我国专利申请人利用专利制度的缺陷滥用专利权,造成了公众、企业不能对公知公用的资源和技术有效利用的反公地悲剧现象,阻碍了科技创新和经济发展.因此,必须从制度上完善专利制度,从源头上杜绝滥用专利权的行为,有效防止反公地悲剧的发生.

| Abstract: | In recent years,there have been happenings of patent applicants' abuse of their patent rights by making use of the loopholes in the current patent regime in China,which resulted in the tragedy of anti-commons,a situation in which the general public and enterprises can not make full use of the common resources and technologies.This phenomenon has baffled the technological innovation and the economic development,thus it is imperative for us to improve the current patent regime,root out the practice of the patent right abuse and curb the occurrence of the tragedy of anticommons effectively. |
