| 摘 要： | 《国际商事合同通则》是针对国际商事贸易活动而制定的规则体系,是一部现代商事合同统一法。然而,我国理论和实践层面都对其关注甚少。本文首先对《国际商事合同通则》做总体叙述;进而对《通则》与我国《合同法》做宏观比较,找出我国立法之不足;最后对司法实践中《通则》之适用予以展望。

| Abstract: | ＂Principles of International Commercial Contracts,＂ the rules system stipulated for the international trades activities, is a modern commercial contracts uniform law. However, there are little concerns about it among the theoretical and practical circles of our country. This paper makes an overall description of it, then compares it with Chinese ＂Contract Law＂ in order to find out the deficiencies in our country s legislation. Finally, there is an outlook on its application to the judicial practice of our country. |
