| 摘 要： | 法律经济学继承了新古典经济学的“经济人”假设和完全理性假设，使其具备了主流经济学的一般性和易处理性的特点，但由于法律经济学缺乏对经济个体行为的分析，从而导致法律经济学无法实现与现实的一致性。法律经济学应该借助于行为经济学的研究方法和研究成果，赋予经济个体以有限自利和有限理性假设，借助前景理论，为法律经济学的拓展提供现实的空间。

| Abstract: | Law and economics carry on the hypothesis of Economic Man and Perfect Rationality.It possesses the characters of essential part of economics.The law and economics cannot fit the reality because lack of the analysis of individual behavior.Therefore,the law and economics should take reference to the studies of economics and endow individuals with limited self-beneficial and limited rational hypothesis so as to develop the basis of behavior economics. |
