| 摘 要： | 实践中,国际商事仲裁裁量权行使的得当与否将关乎仲裁作为解决商事争议方式的地位以及仲裁裁决的权威与公正。文章试分析国际商事仲裁裁量权的特殊性,以个人在国际商事仲裁实践的经验、通过实证论及个人对如何行使国际商事仲裁裁量权的认识,期望对我国仲裁法律制度的完善有所裨益。

| Abstract: | In practice, the determination on discretion of international commercial arbitration makes much of both status of international commercial arbitration and justice of arbitral awards.This paper tries to analyze the speciality of discretion of international commercial arbitration and study on the arbitral discretion in the practice of international commercial arbitration so as to make help to promote Chinese arbitrational legal system. |
