刑事被害人救助体系论说

从目前我国的立法实践来看,构建刑事被害人救助体系是十分必要的,在这个体系中,仅靠被害人自助和求助于被告人补偿目前还很不现实,需要首先在补偿对象及条件、补偿金来源、补偿机构的设置、补偿启动机构及方式等方面建立完善的国家补偿制度,同时完善社会援助机制,这是解决目前被害人不利处境的主要途径。此外,还需完善我国的刑事附带民事诉讼制度,使我国的刑事被害人救助制度更加完善。

Discourse of the System of Victim Assistance

From the current practice of China＇s legislature,to build the criminal victim compensation system is very necessary,but it is far from realistic just only by victim self-help and recourse of offenders.First of all,we need to establish a perfect national compensation system by these ways,such as,the object and conditions of the source of the compensation,the setting-up of compensation institutions,compensation start agency and methods,and so on.While improving the social assistance system,which is the main ways to resolve the unfavorable situation of victim.In addition,it is needed to perfect the system of criminal with civil,to make our criminal victim compensation system more complete.
