| 摘 要： | 最惠国待遇条款作为国际投资协定的一个核心要素,已经成为国际投资领域经济自由化的一个重要手段.但在不同的国际投资条约中,最惠国待遇条款却因各国不同的规定而异,主要区别之一在于最惠国待遇条款是适用于投资准入阶段还是仅仅适用于投资经营阶段.在国际投资协定中将最惠国待遇条款适用于投资准入阶段,既体现了投资自由化的发展趋势,也体现了国际投资领域的发展趋势.

| Abstract: | Most-favored-nation treatment clause, as a core element in international investment agreements, has become an important means of economic liberalization in international investment. However, in different international investment treaties, most-favored-nation treatment clause varies by countries, the main difference being whether it applies to admission of investment phase or just to operation of investment phase. Its application to admission phase embodies the trends both in investment liberalization and in international investment. |
