儒家法文化和先进法文化之立法思想的比较

摘    要:儒家文化和先进文化是中华文化发展过程中出现的两个发展阶段。从法律角度看,儒家法文化主要在我国封建社会中发挥着主流法文化的作用,先进的法文化在我国社会主义时期发挥着主流法文化的作用。两者既然是中华法文化的发展主流,肯定有着深厚的渊源,同时又囚时代不同而在许多方面大相径庭。在立法思想层面,既比较了他们不同的地方,也比较了他们相通的地方,同与不同皆有其内在缘由,分析儒家法文化有助于建设先进的法文化,有利于建设社会主义的法治国家。

Abstract:The Confucianist culture and advanced culture are two stages during the China cultural development.From the law point of view,the Confucianist legal culture is the mainstream culture in the ancient China;the advanced legal culture is the mainstream culture in the modern China.Both of them play an important role in different?period.In the aspect of legislation thought,they have both difference and similarity.To analyze the Confucians legal culture is favorable to the construction of advanced culture and socialism under the rule of law.
