摘    要:随着国家经济实力的提升,维护消费者利益成为当下市场经济法律实施的重点。作为市场经济法律基石的现代反垄断法,消费者利益理应成为其保护的直接利益。通过对“3Q”案的考察,说明了消费者直接提起反垄断诉讼维权的可能,指出了现行消费者保护法所面临的挑战。挑战不仅源于具体规定的滞后,更源于传统倾斜保护模式的不足。建议从维护自由公平竞争秩序入手,推动反垄断法对消费者的直接保护,通过协同保护模式的建立,消解在传统倾斜保护模式下消费者保护的困境,建设合作型消费者保护机制。

Abstract:With the increase in economic strength in China, the safeguard of consumer interests is the focus of the enforcement of current market economic law. As the cornerstone of market economic law, modern antimonopoly law should take consumer interests as its protected direct interests. Through 3Q case study, this paper states the possibility of antitrust lawsuits directly filed by consumers and points out the challenges that face current consumer protection law. The challenges stem from not only hysteretic specified rules, but also the shortcomings of traditional inclined protection mode. Therefore, i, suggests that China should promote direct consumer protection through antimonopoly law from the perspective of maintenance of free and fair competition order, eliminate the predicament of consumer pro- tection under traditional inclined protection mode through the establishment of coordinated protection mode, and establish collaborative consumer protection meehanisms.
