论权力清单制度对行政权的控制与规范

相关法律法规对行政机关行政权限规定的概括性、原则性、模糊性和分散性,使得行政机关在行使行政权过程中存在较大随意性。权力清单制度是对这些法律法规规定的梳理和细化,有利于控制和规范行政权的行使。目前在权力清单制度推行中存在诸多问题,必须采取法制化方式才能保证权力清单制度的有效推行、确保权力清单内容的合法性,并赋予权力清单内容的法律规范效力。为此,要以法律或行政法规形式对权力清单制度进行明确规定,并以地方性法规形式对权力清单的内容予以法制化。

On the Controlling and Regulating of Administrative Power by Power List System

Due to the generality, principle, ambiguity and dispersion about the administrative permission in relevant laws and regulations, the administrative organs are largely voluntary in the exercise of executive power. The power list system can control and regulate the administrative power through combing and refining the provisions of the laws and regulations. At present there are a lot of problems in the practice of the power list system. The power list system should be set in law in order to ensure the effective implementation, the legitimacy of power list content and the compulsory execution of power list. For this purpose, the power list system must be clearly defined in laws or administrative regulations, and the contents of the power list must be specified in local regulations.
