摘    要:民宅商用涉及了住宅所有权人与其他居民的利益平衡问题,《物权法》第77条从“法律法规、管理规约、利害关系人同意”三个层面对民宅商用现象进行了规制。民宅商用是典型的民事行为,解决其所带来的问题不需要政府过多的干预,期待《物权法》具体规则的完善才是从根本上解决民宅商用所带来的社会问题的有效途径。

Analysis of the Legal Problems Related to Private Residences for Commercial Use

Abstract:Private residences for commercial use involve balancing interest between a residence ownership person and other residents. Article 77 in Property Rigbt Law rules the phenomenon of private residences for commercial use in 3 aspects: laws and regulations, administrative statute and the agreement of interested parties. Private residences for commercial use are a typical civil act and to solve the problems resulting from it does not need more government intervention. Perfecting Property Right Law is the only effective way to tackle the social problems concerning private residences for commercial use.
