| 摘 要： | 大陆法系的情势变更原则与英美法系的合同落空原则 ,它们设定的目的都是为了救济不正常风险所带来的显失公平。从历史沿革和本质来看 ,它们的内容基本相同 ,但也有区别 :即英美法系从衡平法的观点来确认情势变更原则 ,而大陆法系则从诚实信用出发来确定情势变更原则。

| Abstract: | Mainland law system's changed circumstances and English-American law system's principle of changed circumstances were all built in order to save clear unfair that brought by unfair risk. They have the same content from their history and essence, but they also have some differences, That is English-American law system built principle of changed circumstances from Balance-Law, but Mainland law system built from Honest Principle. |
