| 摘 要： | 重庆打黑事件在一定程度上反映了人治的续存。对人治续存进行文化解释已经难以令人信服，而采用经济学方法加以解释能够得出更有说服力的结论。经济学的制度变迁理论，能够说明人治续存并发生作用的制度原因，而成本收益理论则能够说明法治在当下“难产”的原因。从法经济学角度对人治与法治进行分析，能够帮助人们获得对法治建设更为有益的智识与贡献。
