现阶段我国水库移民的法定权利评析

水库移民问题的实质是权利问题,对移民权利的法律规定不足是现阶段我国水库移民受侵害事件常发的重要原因。以水库移民的应然权利为对照,对当前以《大中型水利水电建设征地和移民安置条例》为代表的我国水库移民法律体系中有关移民权益保障的法律条款进行梳理,发现现行的法律法规中水库移民的财产权、生存权、发展权、参与权、监督权等虽已作一定的表述,但仍存在一定的改进余地;而水库移民应该享受的环境权和救济权在法律表述上还处于空白。对立法上如何完善水库移民权益保障提出了若干建议。
