业主自治管理权问题的立法检讨

摘    要:规范的物业管理是构建和谐社会,创建和谐社区的核心因素,由物权派生的业主自治管理权的切实落实并有效维护,是搞好物业管理的前提条件。但现行《物业管理条例》对业主大会成立所设定之前置障碍,其实是立法者在对业主进行“无知”推定、“有错”推定的思维范式下所犯的“行政依赖症”的通病,应予修订;而在物业服务收费之财产权归属方面规定不明,更是导致现实生活中“立法性纠纷”产生的重要因素。因此,建议通过立法设立物业管理基金制度。

Abstract:The standard real property management is the keystone of establishing a harmonious society and setting up a harmonious community.To carry out the proprietor management autonomy derived from property completely and to maintain it effectively is the precondition of real property management.However,the existing Law of Real Property Management has set some obstacles for the establishment of the owner's committee,which is the embodiment of the legislator's thinking mode of presumption of ignorance and presumption of guiltiness imposed on the proprietor.It is the typical illness of administration reliance which should be modified.Moreover,the ambiguity of real property management service charge leads directly to the legislative dispute in reality.Therefore,this paper proposes the idea of establishing the real property management fund system.
