法社会学视野下农村环境群体性事件的发生机理及防治路径

法社会学是将法律置于社会背景当中,研究法律现象和其他社会现象的相互关系的一门新兴的边缘学科。法社会学视野下农村环境群体性事件的发生是社会转型引发的利益冲突、农民的环境利益诉求渠道不畅、农民环境权的法律保障制度不完善、司法救济对农民的环境权保护不足等因素共同作用的结果。法社会学视野下农村环境群体性事件的防治路径包括化解政府与农民的利益冲突、畅通农民的环境利益诉求渠道、完善农民环境权的法律保障制度以及加大对农村环境污染受害者的司法救济力度。

Analysis on the Occurrence Mechanism and Control Path of Rural Environmental Group Events from the Perspective of Sociology of Law

Sociology of law is a new interdisciplinary subject that places the law on the social background,and that study the relationship between legal phenomena and other social phenomena.Rural environmental group events had their occurrence mechanism from the perspective of sociology of law,that is to say,they result from the combination of factors including the conflict of interests caused by social transformation,the channels of farmers＇ environmental benefit demand were not open,the legal security system of farmers＇ environmental right was not perfect and the shortage of judicial relief to the protection of farmers＇ environmental right.The approaches to the control of rural environmental group events from the perspective of sociology of law are to resolve the conflict of interests between government and farmers,to open the channels of farmers＇ environmental benefit demand,to improve legal security system of farmers＇ environmental right and to increase the intensity of judicial relief to victims of environmental pollution in rural areas.
