| 摘 要： | TRIPS协定第15条第5款规定了成员的商标注册程序保障义务,公布与撤销程序是成员必须承担的义务,异议程序则是选择性义务。此外,成员应遵守纳入TRIPS协定的巴黎公约以及TRIPS协定第四部分中的相关规定。由于我国设置的异议程序超出了TRIPS协定义务最低要求,商标法第三次修改可以对此做出灵活调整。
