| 摘 要： | 本文通过对独占交易经济分析的回顾,阐述了独占交易经济效应的基本理论和观点,以及独占交易的市场效应和对社会福利的影响,根据独占交易的经济分析,认为对独占交易的反垄断认定原则应采用合理推定原则,美国和欧盟的执法也显示出这一特点。基于独占交易的经济分析和国际执法实践,本文提出了独占交易的反垄断检验规则,为独占交易反垄断立法和执法提供一定的理论依据。

| Abstract: | This paper surveys the recent development of the theories of exclusive dealing, expatiates on primary theory, and analyses the market effect and social welfare of exclusive dealing strategy of the firm. Based on those economic theory, we should apply the reason rule on exclusive dealing in antitrust field. The enforcement on exclusive dealing in US and EC is keep up with the economic theory. Based on these analyses, we point analysis some rule for exclusive dealing antitrust legislation and enfforcement. |
