| 摘 要： | WTO争端解决机制中适用法律的范围，一直是国际法学界存在争议的问题。国内学术界的“遏说”似乎是，专家组和上诉机构在审理案件时所适用的法律仅限于WTO协议的有关规定，一般国际公法并不能作为WTO争端解决机制所适用的法律渊源，而仅能作为“解释性渊源”。这一观点在某种程度上是对WTO《关于争端解决的规则与程序谅解书》及有关WTO争端解决实践的误读。为确定WTO争端解决机制所适用的法律，就需要对WTO专家组的“管辖权”、“法律适用”以及“法律解释”这三个概念进行必要的区分。

| Abstract: | The range of legal applicability in the system of settling disputes in WTO＂ s Dispute Settlement has been a controversial problem existed in international legal circles. The general saying in domestic legal circle is that the law used by experts and courts is only applied in agreement of WTO, the general international public law could not be used as the legal origin of the system of settling disputes, but as ＂explanatory origin＂. This viewpoint is the result of misunderstanding of ＂Memorandum of Understanding of the Stipulations and dispute settlement procedures＂ and related practices. In order to solve legal applicability of it, we need to classify three concepts of experts in WTO, that is, ＂jurisdiction＂, ＂legal applicability＂, and ＂legal explanation＂. |
