论我国企业职工参与制度的法律完善

由职工参与企业经营与决策是当代各国法律普遍关注的问题。职工参与制度根植于经济民主理论和人力资本所有权理论具有深厚的理论基础。我国法律中确立的职工参与形式多样,但也存在诸多问题。在建立现代企业制度的进程中,统一相关立法,进一步加强和完善职工参与制度,既是建设企业民主和建立和谐劳动关系的需要,也对于维护经济发展和社会稳定具有重大意义。

Research on the System of Workers' Participation in China

The system of the workers' participation has been set out in legal system of the western developed countries since the mid-20th century. This system enjoys profound theoretical basis. In China, it has been stipulated in different laws. The workers' right to participation in enterprise can be realized through various ways. Much deficiency has arisen in both legislation and practice. Therefore, it is necessary to unify the regulations and to improve this system in China.
