| 摘 要： | 目前,企业破产程序中划拨土地使用权抵押权的实现主要存在着两个方面的障碍:一是地方政府不规范收储划拨土地使用权;二是《破产法》第132条的限制。因此,首先,要规范地方政府的土地收储行为;其次,须完善《破产法》第132条。

| Abstract: | In judicial practice, enforcement of right of mortgage on allocated land use right meets two obstacles during insolvent proceedings. One obstacle is that local government takes back allocated land use right without standardization; The other obstacle is the restriction of Article 132 in Law of the People's Republic of China on Enterprise Bankruptcy (2006) . Therefore it is necessary to regularize government action to take land back and perfect Article 132. |
