文化与贸易：WTO体制下进口电影审查制度的法律分析

因WTO的贸易自由化宗旨及历史原因，WTO的现行规则未因电影产品的文化和经济属性对其内容审查制度存有“特殊待遇”条款。WTO成员既不能以电影的文化性采取贸易限制措施，也无法有效适用“公共道德”例外条款证明其违反相关贸易承诺的正当性。为履行“入世”承诺，中国唯有在国内层面上经过适当的法律协调，国际层面上相关成员方共同的长期努力，才能使电影的文化性、服务性受到重视，享有相应的特别待遇。

Culture and Trade： Legal Analysis of the Censorship of Import Films under WTO

Owing to the WTO purpose of trade liberalization and historical reasons, cur- rent legal rules lack terms of special treatment concerning the censorship of films based on their cultural and economic features. WTO members can not take trade-restrictive measures according to the cultural attribute of films, and also can not effectively apply the term of pub- lie moral exception to prove the legitimacy of its violation of relevant trade commitments. In order to fulfill WTO commitments, China shall make appropriate legal coordination at domes- tic level, as well as long-term efforts of relevant members at international level, thus placing emphasis on cultural and service attributes of films and making films enjoy relevant special treatment.
