失地农民权益保障的制度经济学分析

农民有职业和身份两个层次上的涵义，随着社会经济的发展，身份上的农民概念和职业上的农民概念在农村非农化过程中出现了越来越大的差距，失地农民开始出现。在经济现实与制度跟进不对称的情况下失地农民的权益保障成为一个突出问题。研究表明，土地产权模糊、征地补偿标准不科学以及现行土地管理制度混乱等是造成失地农民权益不能得到有效保障的重要原因，失地农民被边缘化了。为此，改革现行土地产权制度、规范征地补偿标准势在必行。

Institutional Economy Analysis on Rights and Interests Guarantee For Farmers Losing-Land

With the development of social economy, during the course of urbanization, the gap between farmers in the sense of identity and farmers in the sense of profession is getting wider, thus farmers losing land coming into being. Studies show that the obscure land property rights, unscientific standards for land expropriation and disorderly land management institution are the key reasons for having not effectively guaranteed the rights and interests of farmers. So it is urgent to reform the current land institution and standardize land expropriation compensation level.
