| 摘 要： | 代孕分为基因型代孕和妊娠型代孕。"8胞胎"案揭出我国代孕无法可依的窘况。本文认为妊娠型代孕应该合法化,并从代孕监管机构、代孕主体条件、代孕合同的基本内容、代孕医疗机构和中介机构的准入,以及代孕儿的权利保障5个方面对代孕进行法律规制。

| Abstract: | Surrogate will be divided into genetic surrogate and surrogate type pregnancy surrogate. Eight fetuses case could not be in a surrogate, Points out that the pregnancy surrogate should be legalized type, and from the surrogate regulators, surrogate subject conditions, the basic content of surrogate contract, surrogate medical institutions and the intermediary agencies access and a surrogate son of the rights of a surrogate for five laws and regulations, in order to help surrogate legislation. |
