| 摘 要： | 刑法价值取向决定犯罪概念的内容.以维护政府权力为目的的刑法多采用实质的或混合的犯罪概念;以保障市民社会权利为目的的刑法多采用形式的犯罪概念.随着中国社会转型程度的加深,我国刑法的目的开始由保卫政府权力转向保障市民社会的权利,因此选择以罪刑法定为指导的形式犯罪概念更能体现我国在刑法价值取向上的转变,更有利于充分发挥刑法的作用.

| Abstract: | The value orientation of the criminal law determines the content of the criminal concept.The criminal law which aims to maintain the government power always adopts essential or mixed concepts,and for the criminal law which is aimed at safeguarding citizens' social rights,formal concepts are usually used.With the strengthening of China's social transition,the aim of the criminal law begins to turn to safeguarding the citizens' social rights from maintaining the government power.To adopt the criminal concept which is guided by the principle of legally prescribed punishment for a specified crime can embody the transformation in value orientation more properly,and can help to bring the criminal law's function into full play. |
