| 摘 要： | 信访救济制度功能不健全、行政复议制度救济功效有限和行政诉讼制度救济途径残缺是导致农地征收纠纷救济手段失效的重要原因。文章提出建立一种"以政府管理理念创新为先导,以行政裁决制度为重点,以行政诉讼制度为核心,以其他救济手段为补充"的多元化的农地征收补偿安置争议救济机制,以化解征地矛盾,解决征地纠纷,保护失地农民合法权益。

| Abstract: | The most important reasons that relief methods lose effectiveness on the disputes of farmland expropriation come from the incomplete functions of the system of correspondence and visitations from the masses,the limited functions of administrative review system and the deformity of administrative lawsuit system.The paper advises multiple disputes relief methods of farmland expropriation compensation and settlement,such as guiding with government management concept innovation,centering on the system of specialized administrative adjudication,emphasizing administrative lawsuit system and supplementing other relief methods,to solve disputes and protect legitimate interest of land-losing peasants. |
