| 摘 要： | 现行法律对探矿权人优先权的规定非常模糊,业界人士对其认识也莫衷一是。文章从探矿权人优先权制度的依据、探矿权人优先权法律关系、法律效力和保障制度四个方面,论述了探矿权人优先权属于优先购买权,从法理上解析了探矿权人优先权的法律性质,并对构建我国探矿权人优先权法律制度提出了设想。

| Abstract: | The stipulations about exploration right holder's priority in present laws isn't clear and definite. The experts in this field have different opinions as well. The paper analyzes the basis of exploration right holder's priority system, the legal relationship and the legal effect of exploration right holder's priority and its guarantee system, discusses that exploration right holder's priority belongs to purchase-priority, explain the legal character of exploration right holder's priority from the angle of legal principle. At last the paper puts forward proposals for construction of legal system of exploration right holder's priority. |
