从基因资源问题看与贸易有关的知识产权体系的未来

入世十年以来,中国在参与制定多边规则、维护发展中国家利益方面的经验日益丰富。在这十年中,发展中国家与发达国家之间就是否将基因资源和传统知识等纳入世贸组织《与贸易有关的知识产权协议》(TRIPs协议)展开了激烈的争论。文章认为,目前基因资源产品市场虽然规模庞大,但是发展中国家在整个生产链中获益较少,其在基因资源和传统知识领域的优势难以转化为现实经济利益,目前的市场制度难以为发展中国家保护生物多样性提供足够的经济刺激。改革多边知识产权体系有利于平衡南北之间在知识产权领域的利益,提高发展中国家参与多边知识产权体系的积极性,也有利于保护生物多样性。
