| 摘 要： | 《鹿特丹规则》是国际海上货物运输合同统一法的本位回归。《鹿特丹规则》的背离规定是国际海上货物运输合同自由的最直接体现和合同自由空前扩大的标志。在国际贸易实务中,当事人应对任何与背离有关的事项进行成本和利益的权衡分析。在《鹿特丹规则》背景下的批量合同和保险场合下对Incoterms 2000的贸易术语的选择显得更加重要。
