我国土地使用权“分层设立”必要性和可行性

随着城市化的发展,土地利用呈现由平面化向立体化开发的发展趋势。但是,我国法律对土地使用权出让还仅局限于地面土地使用权,不能满足用地需求和节约利用土地的要求。而土地使用权的"分层设立"为有效缓解我国目前土地使用权的供求矛盾,提高土地利用的效能开辟了新的道路。因此,对土地使用权"分层设立"的必要性、可行性进行研究大有裨益。

With the development of urbanization,the trend of land resources utilization from flattened to three-dimensional development,but China’s laws on the land use rights are limited to the ground,the land use right cannot meet the land demand and the requirements of the use of land effectively.Land use right layered set up in our country can relieve the contradictions between the supply and demand of the right to use the land,and give a new way to improve the efficiency of land use.Therefore,it is great helpful for us to study the necessity and feasibility of our country’s land use right.
