我国遭遇反补贴调查的现状与对策

自2004年加拿大对我国开启反补贴调查之始,截至2019年7月31日,国外针对我国的反补贴调查共170起,以“反补贴”名义产生的贸易摩擦不容乐观。我国遭遇的反补贴调查呈现行业涉及广、反补贴税率高、调查内容被不同的国家复制;日落复审基本沿袭原审终裁的特点。我国不能长期处于被动应对反补贴调查及被采取相应措施的状态,从政府层面需要规范补贴的制定,避免专向性;企业层面积极应诉;专业行会是政府与企业之间的桥梁。

The Current Situation and Countermeasures for Countervailing Investigation against China

Since 2004,Canada launched the first countervailing investigation against China.As of July 31,2019,foreign countries had conducted 170 countervailing investigations against China,and the friction caused by the name of"anti-subsidy"was not optimistic.The countervailing investigation against China involves a wide range of industries,has a high countervailing duty rate,and the investigation content is copied by different countries.Sunset review basically follows the characteristics of the final judgment of the original trial.China cannot be in a state of passively responding to countervailing investigation and being taken corresponding measures for a long time.The government needs to regulate the formulation of subsidies to avoid specificity;enterprises should actively respond to lawsuits;professional association will be the bridge between the government and enterprises.
