十一届三中全会以来土地制度的变迁及政策建议

十一届三中全会以来,我国确立了以家庭承包经营为基础、统分结合的双层经营体制,确保了农民对集体土地的经营和使用权。2002年的《土地承包法》规定农民对土地的承包经营权可以依法采取转让、出租、入股、抵押或者其他方式流转,进一步扩大了农民对土地的承包经营和使用权限。与此同时,国家还逐步完善了对农民土地的征用办法和程序以及对农民的补偿安置办法。但是,十一届三中全会以来的土地制度变革在土地产权、政府征地安置补偿和土地流转等方面还存在着诸多问题,因此在新的土地制度变革过程中,还应进一步确保农民对土地的产权、完善征地制度和规范土地流转。

Since the Third Plenary Session, our country established combines unified and separate tier management system, based on the family contracting business to ensure that the farmers＇ management and use rights for the collective land . ＂Land Contract Law＂（ 2002 ） provisions of the farmers on the land contract and management rights can be taken legally transfer, lease, equity, mortgage or otherwise transfer which further expands the contract management and usage rights of farmers on land. At the same time, the state also gradually improve the expropriation and procedures of land for farmers as well as the compensation and resettlement measures for farmers. However, since the Third Plenary Session, there are still many problems about the land system change in the land ownership, the government resettlement compensation, land transfer and other aspects. So the new land system in the process of change, we should further ensure that farmers on the land property rights, improve the land requisition system and regulate land transfer.
