| 摘 要： | 居住权发端于罗马法中的人役权制度,以使用他人房屋为居住目的。随着社会的发展,这一制度逐渐演变和扩展,并为大陆法系国家所继受。法国与德国亦继受了这一制度,然而两国对这一制度的规定却有不同,拟作一定的分析。

| Abstract: | Residing right originates from servitude right system in Roman law,takes using other person's house as residing purpose.Along with the development of society this system evolves and expands gradually,are accepted and inherited by the continental law system.France and Germany also accept this system,but their systems are different on the aspects of property cognizance and legislation situation. |
