中国农村土地承包经营权流转制度现状与完善

针对中国农村土地承包经营权流转制度存在的现实缺陷,我们一方面应当通过立法明确农村土地承包经营权的物权属性和各项流转方式、扩大农村土地承包经营权的流转范围、明确流转双方当事人的权利义务关系;另一方面,我们应该健全农村社会保障制度,培育农村土地市场,缔造中介服务组织,转变政府管理职能,改革现行户籍制度,加快农村产业结构调整和农村城镇化进程,建立"流民潮"防范机制,保持社会稳定。坚持这两方面改革的同时推进,有力推进中国农村土地承包经营权的有序流转。

The present situation and consummation of the circulation system of the Right to Contracted Management of Rural Land in China

Facing the realistic flaw of the circulation system of the right to contracted management of rural land in China,on the one hand we must confirm the real right attribute and each circulation way,expand the circulation scope,regulate the relations of both parties' rights and obligations explicitly.On the other hand,we should improve the countryside social security systems,cultivate the countryside land market,create the intermediary service organization,transform the government manages functions,reform present household register system,speed up the advancement of the countryside industrial structure adjustment and the countryside urbanization,establish guard mechanism for "the refugee tide" to maintain social stability.With these two aspects reform,we can powerfully advance the right to contracted management of rural land in China circulate orderly.
