| 摘 要： | 本文论述了律师在公诉案件审前程序的地位和作用，指出在我国刑事诉讼审前程序中，律师由于其法律地位及享有的诉讼权利受到种种限制，在实践中根本无法发挥其维护委托人合法权益的作用，导致司法实践中对犯罪嫌疑人的人权保护不力。

| Abstract: | This article discusses the position and role a lawyer plays in the public indictment case of pre-trial procedures.It also points out that in China's pre-trial criminal proceedings in practice,lawyers could not play in safeguarding their client's legitimate rights and interests of the clients,because of all kinds of their restrictions in legal status and legal rights,which leads to the judicial practice of the suspect's poor human rights protection. |
