| 摘 要： | 法律规定的集体住宅用地仅限于集体经济组织成员自住的宅基地,且不得流转。但这一规定与实际状况大相径庭,且既不符合物权法基本原理,也损害了广大农民的利益。可从＂同地、同权、同价＂的角度,扩大集体住宅用地的主体范围,重构集体住宅用地制度。

| Abstract: | Law confines collective housing land usage to collective economic organizations’ members, and untransferable. However, this stipulation doesn’t serve the actual situation, and is inconsistent with the basic principles of property law, but also damage the interests of the peasants. This article, based on ＂the same land, the same rights, same price＂, proposes to expand the subject scope of collective housing land, reconstruct collective housing land usage system |
