| 摘 要： | 长期以来,刑事诉讼中辩护律师调查取证是我国司法实践中的“老大难”问题之一,《刑事诉讼法》修订后,虽在举证、质证、认证方面都吸收了当事人主义与对抗思想有了重大的转变,但在律师调查取证权问题上反而限制了律师应有之权利,不利于律师很好的履行辩护人的职责,为了保护犯罪嫌疑人、被告人的合法权益,本文着重对律师调查取证权进行探析。

| Abstract: | The Solicitor's right of investigation and Collecting evidence in criminal suit is a very difficuet question for a long time past.The revised the Law of criminal Suit has been improved,but the solicitor right of collecting evidence is restrained.This is unfovorable to the solicitor to carry out their duty.The author put forward a few suggestions. |
