风险社会背景下食品安全事件的刑法应对

食品安全关系到人民群众的生命健康安全，关乎国民经济健康发展和社会和谐稳定。近年来，我国发生的食品安全事件体现出了风险社会的鲜明特征，足以表明我国社会正从工业社会向风险社会逐步过渡。风险社会背景下，传统刑法无论在观念、功能还是刑罚目的上都发生了变迁。为应对食品安全事件的发生，我国刑法需从刑事政策、刑事法网、罪名体系、刑罚制裁四个层面相应进行调整。

Criminal Measures on Food Safety in a Risk Society

Food safety is concerned with the health and security of people’s life,and with the sound development of national economy and social harmony and stability.Recently,the food safety incidents in our country have presented the distinctive features of a risk society,which is sufficient to show that our country is transiting from an industrial society to a risk society.The traditional criminal law,in the risk society,has changed whether on the concept and function or on the purpose of punishment.The criminal law of People’s Republic of China should be adjusted from such four aspects as criminal policy,criminal circle,accusation system,and punishments to cope with the issues on food safety in a risk society.
