土地承包经营权流转的物权法分析

土地承包经营权流转的经济发展功能和社会保障功能如何协调统一,是土地承包经营权流转能否彻底物权化的关键,2007年3月出台的《物权法》对此进行了尝试,然而遗憾的是物权法对于土地承包经营权流转的物权化却不是那么彻底。本文从物权法理论的角度出发,指出了目前土地承包经营权在流转中存在的问题,并分析了问题存在的根源所在,最后有针对性地提出完善土地承包经营权流转制度的建议。
