论法治的市场构造

法治并未消除社会业已存在的矛盾,只是改变了社会解决矛盾的方式,但这一方式不能被任意地创造。市场经济基于自身特殊的生产方式,能够将法治这一文明的社会治理手段构造出来,使人类进入法治社会。市场经济通过自己固有的存在于各经济主体之间的经济制约关系的能动作用,为法治规定公正的价值标准,提供支承的决定力量,构建基本的社会秩序,使法治获得至上权威并得以确立。但市场经济构造法治,其经济制约机制必须健康,这种健康离不开它所需要的产权制度作基础,同时排除各种因素对这一构造机制的干扰。

A Research on the Market Structure under the Rule of Law

The rule of law changes the means to solve social contradiction rather than clear up the existing contradiction,which can't be generated arbitrarily.Based on its special pattern of production,market economy can generate the rule of law--the social governing means in ruling by law and leads the society to a legal society in the following ways:by stipulating the standard of value to supply the deterministic force through the standard of dynamic role of economic relationship between the various economic subjects;by establishing basic social order to obtain absolute authority of ruling by law.The economic restriction mechanism in ruling by law in market economy must be in a sound state on the basis of property right and preventing the various elements from disturbing the mechanism.
