传统知识概念界定及特性研究

传统知识保护是新一轮WTO多边谈判和WIPO探讨的议题之一，但至今未取得实质性进展。传统知识是现代社会日益重要的经济资源，其概念界定及特性研究是制约国际社会对此题进行深入探讨的瓶颈。从知识产权保护视角下对传统知识的概念作出界定。强调其是一种人类群体智力活动产生的未以现代知识形态表达的不断传承、发展的知识形态，同时找出其特性所在，是优化传统知识资源配置和法律保护的最重要前提。

On Concept and Characteristics of Traditional Knowledge

The protection of traditional knowledge has been put on the agenda of WTO and WIPO, but they failed to make progress on this issue. The tradional knowledge is the important economics resources. The concept and characteristics research are the bottleneck which condition the international society approach it throughly. In this thesis, we define traditional knowledge from the angle of intellectual property protection and emphasize it is a knowledge existence that human beings created, which has not the form of the modern knowledge but has been constantly inherited and developed. At the same time, We analyze the characteristics of traditional knowledge and put forward the protection of traditional knowledge will benefit mankind, so we should protect traditional knowledge with intellectual property.
