基于地役权的电网建设用地征地补偿模式研究

研究目的:利用《物权法》中的地役权概念,结合电网建设征地的实际情况,设计以地役权为基础的电网建设征地补偿模式。研究方法:文献研究法,理论研究和系统分析法。研究结果:电网建设用地中的限制用地符合地役权的成立要件,可对其设置地役权,获得该项权利需支付地役权利金,其金额可采用权利比率法进行估算。研究结论:以地役权为基础的电网建设征地补偿模式对电网的建设、运营和维护可起到良好的促进作用,但在实践中大范围推行则需做好前期的法律、政策和技术工作。

Pattern of Compensation for Land Expropriation Due to Grid Construction from the Easement Perspective

The purpose of this paper is to design a pattern of compensation for land expropriation due to grid construction based on the easement concept written in the Property Law and the actual practice. Methods employed include documentation, theoretical study and systematic analysis. The result shows that character of restrictive type of land after the grid construction accords with the establishment conditions for easement. If a grid company wants to obtain the easement, it should pay a fee for the transfer of the easement right. The amount of the easement fee can be calculated by a rights-rate method. It is concluded that the pattern of compensation for land expropriation due to grid construction based on the easement can favorably promote the construction, management and maintenance of the grid. However, the issues related to the laws, policies, and techniques should be settled before a large-scale practice.
