| 摘 要： | 经济法是我国法律体系中一个非常年轻的法律部门,经济法的产生是经济法基础理论中一个重大的研究课题。关于经济法产生的理论,学者的分析多集中于经济法产生的经济与社会基础,较少论及其思想基础。然而,法律思想在新的法律部门产生中起着重要的影响,追溯影响经济法产生的法律思想,对加深经济法基础理论研究意义重大。

| Abstract: | Economic law is a very young legal sector in the legal system of our country and the emergence of economic law is a great study task in the fundamental theories of economic law. About the theory of the emergence of economic law, the analyses of scholars concentrate mainly on its economic and social foundation and few analyses talk about its idea foundation. However,legal ideas have important influence on the emergence of new legal sectors. Exploring the legal ideas influencing the emergence of economic law is of great significance to the further study of fundamental theories on economic law. |
