| 摘 要： | 研究目的:在征地补偿中需要强化农户土地承包经营权的法律地位,实现其直接权益。研究方法:文献资料法和案例分析法。研究结果:征地补偿的对象除原有意义上的所有权外,还应包括土地承包经营权等用益物权,但该权利在征地中却被忽略了。研究结论:明晰土地承包经营权在征地中的法律地位将对征地制度改革全局产生根本性的影响,现阶段需要建立规范的土地承包经营权登记发证制度;在修订法律法规时明确土地承包经营权可以获得独立的权利补偿。
