摘    要:
《中华人民共和国劳动法》之所以将劳动合同规定为要式的、书面的合同 ,意在强化用人单位和劳动者的合同意识 ,维护双方的合法权益。尽管如此 ,现实生活中 ,事实劳动关系大量存在 ,不仅给用人单位带来极大的隐患 ,对维护劳动者的合法权益也极为不利 ,而且还严重干扰了劳动力市场的正常运行秩序。明确阐述事实劳动关系的概念及其特征 ,全面分析事实劳动关系对用人单位和劳动者的影响及产生事实劳动关系的原因。

Abstract:
The Labor Law of the People's Republic of China aims to strengthen the contractual awareness of employers and laborers, and protects bilateral legal rights and interests, requires labor contracts to be written in a precise, patterned form. In spite of that, the existence of so much non-contractual labor relationships not only brings about a great potential threat to the employers but also is disadvantageous to the laborers' legal rights and interests. Moreover, it seriously disturbs the normal operating order of the labor market. In this article, the concept and features of the non-contractual labor relationships are presented, the reasons for its generation and its influence on both employers and laborers are analyzed overall.
