工程造价司法鉴定专家证人制度浅析

随着科技、经济的不断发展,诉讼案件越来越多样化、复杂化,经常涉及一些专业的问题,给法官的审判带来种种困难。尤其是建设工程案件,工程造价的鉴定尤为复杂,鉴定机构和鉴定人员的专业水平参差不齐,这让法官审判更是难上加难。最高人民法院于2019年对《最高人民法院关于民事诉讼证据的若干规定》进行了修正,对专家证人做了明确的规定与要求。文章从工程造价专家证人的背景及意义、法律依据、与普通证人及鉴定人员的区别、责任与义务以及目前存在的问题与建议几个方面进行了阐述分析,认为在目前的司法证据制度下,工程造价专家证人的制度是合理的、必要的,也是很有意义的,应该进一步加强,并在实施过程中不断改进存在的问题,最终让其发挥更大的作用,为建设工程案件司法公正护航。

An Analysis of the System of Expert Witnesses in the Judicial Appraisal of Engineering Cost

With the continuous development of science and technology and economy,litigation cases are becoming more and more diversified and complicated,often involving some professional issues,which bring difficulties to the trial of judges.Especially in construction engineering cases,the identification of the cost of the project is particularly complex,the professional level of the appraisal institutions and apprases is uneven,making the trial of judges even more difficult.In 2019,the Supreme People's Court amended the"Several Provisions of the Supreme People s Court on Evidence in Civil Procedure"and made clear provisions and requirements for expert witnesses.This paper expounds and analyzes the background and significance of the expert witness of the project cost,the legal basis,the difference between the ordinary witness and the expert,the responsibility and obligation,and the existing problems and suggestions,and thinks that under the current judicial evidence system,the system of the expert witness of the project cost is reasonable,necessary and meaningful,should be further strengthened,and in the process of implementation,the existing problems should be continuously improved,and finally let it play a greater role in the judicial justice escort of the construction project case.
